Tragic Bar Shooting Unfolds in Self Defense: In the early hours of November 21, a regular night at El Torero, a restaurant and bar in Pajaro near Watsonville, ended tragically with two deaths and several injuries. However, self-defense and legal issues cloud the occurrence.
The focal point of the incident was a 36-year-old man, Gerardo Hernandez Herrera, who entered the establishment armed. A confrontation ensued with another patron, a 47-year-old Watsonville man. What started as a heated exchange quickly escalated when Hernandez Herrera allegedly opened fire. In a matter of seconds, the other patron drew his firearm, responding in self-defense. The exchange of gunfire lasted a mere 3.5 seconds but resulted in fatal wounds for both Hernandez Herrera and an innocent bystander, identified as Jenny Carolina Martinez Bejarano, a 36-year-old woman from San Jose.
The aftermath revealed a chilling reality – a tragic consequence of self-defense where innocent lives were unintentionally caught in the crossfire. Three other individuals sustained non-life-threatening injuries, adding further complexity to an already somber situation.

Monterey County District Attorney Jeannine M. Pacioni declared the shooter’s actions self-defense. California law considers self-defense that injures or kills an innocent bystander a regrettable consequence, not a crime. The shooter is responsible for all injuries and deaths.
The surviving shooter, a Watsonville resident, is expected to face a felony charge for carrying a loaded firearm in public, offering a stark reminder of the fine line between self-defense and unintended tragedy.
